| Franchising, having now occupied a special place in our market economy, was introduced into China in the 80's of the 20th century. Market economy, in essence, is governed by law. But the regulation of franchising lags far behind its development. At present, there exist no relevant laws or statutes regulating franchising. Therefore, how to deal with this problem has presented the law field with a new and challenging subject. This paper, from the perspective of commercial law and with reference of regulations concerned, explores the approaches to regulating franchising in a legal sense, pointing out that the regulation of franchising should take the law adjustment as its basis while supplemented by the norm of self-control. |
