Lawyers are social workers who provide professional services of law,their offence due to their professional activities should be regulated and restricted by criminal law. But all of these regulations should also be in accord with the principle of legislation. From the lawyer's point of view,this thesis researches the crime of defender and agent ad litem's destroying evidence,falsifying evidence,and interfering with witness. Actually,in which lawyers are the specified subjects.This thesis consists of four parts. Part one analyses the characteristics of the constitution on the crime mentioned above and cognizance in judicature;in Part Two,the thesis emphasizes and discusses the limitations in legislation and the effect in the judicial practice concerning the crime. Therefore,the thesis negates the legislative rationality of the crime;The third part is an anatomy of the reason of the deficiency including political,historical,realistic and so on;at last,the thesis provides some suggestion of how to choose the legislative tropism of value,and consummate the regulation of the contents of the crime.
