Study On Limitation Of Liability For Oil Pollution Damage Caused By Ship's Collision In China

This thesis mainly discussed the question of limitation of liability for oil pollution caused by ship collision in China.In the first part, the author analyzed the two important elements of this thesis-ship's collision and oil pollution damage. Because the point of this thesis was limitation of liability, then, the author deeply analyzed and compared CLC with our domestic law related to limitation of liability.In the second part, the author described the different circumstances concerning oil pollution in Chinese sea area and analyzed the application of law, the main body of limitation of compensation etc. The function of using chart and examples made the point more directly. Furthermore, the author pointed the fault and the blank of our internal law.In the last part, the author gave some personal opinions and suggestions of legislation about current domestic law with regard to oil pollution damage.The value of this thesis was its practical aspects. It is made the question easy to resolve through consulted many legal documents and expert's idea and had a detailed discussion of risks of oil pollution in our sea area. The suggestion of legislation made the thesis a perfect end.
