To any society ,the function of police is an indispensable component of the functions of the state .The operation of the power of the police in a society to a great extent represents the degree of this society governed by law .The power of the police ,under certain condition,is inversely proportional to the rights of citizens,that is ,the expansion of the power of the police results in the shrinkage of the rights of citizens,and the abuse of the power of the police brings the rights of citizens into naught.Therefore, the police society is opposite to the society governed by law .In a police society,power, without any restraint,is superior to law, While in a society governed by law Jaw is supreme and power is under the restriction of law,At present,theprinciple of governing the state by law is drafted into the constitution of China,towards which there exist many different attitudes.However,there is no denying that the key point of realizeing government by law lies in the restraints on power. The existence of the power fo the police is attributed to its function of upholding the stability of the society.However,the power of the police in our country is featured by its monopoly,extensiveness and superiority,where is a great barrier to the exercise of the rights of citizens.Hence,the initiation of government by law requires there straints on the power of the police,especially the power of criminal police.The practical approaches are as follows:one is the separation of the power of the power of the police.and the other is the expansion of the rights of the police.Through these effective approaches,it is hopeful to realize the purpose of government by law through perfecting the power of criminal police.
