Research On The Establishing Of The Relatively Concentrate Administrative Punishment And Its Relief

The system of the power of relatively concentrate administrative punishment, was established in the Administrative Punishment Law. As an effective way of dealing with the malpractice in enforcing the Law, it is paid much attention in the practical and theoretical circle. But to my disappointment, the research achievement is little. The thesis aims at exploring the system, based on my theoretical study and practical investigation. I hope faithfully experts and teachers point one my mistakes so that they can be corrected. The thesis consists of the following parts:The first part expounds the theoretical foundation and producing background of the system and the concern issures during establishing is.The second part explored the theoretical bases of jurisprudence, constitutionalism, administrative Law and administration.The mini part demonstrates the necessities of establishing the system in four aspects such as protecting the administrative relative party's rights, preventing the abusing the administrative power, improving the administrative efficiency and lowering the administrative efficiency and lowering the administrative cost; and feasibilities of popularizing it in two aspects such as the legal basis of establishing it and the effect of trying out it.The fourth part discusses the designs of the system, including setting up the organizations and the scope of application and exercising procedures. The fifth part expounds the relief system afterwards, mainly including administrative reconsideration, administrative litigation and administrative compensation.
