Study On The Transfer Of The Collective Ownership Constructin Land In Our Country

In recent years , it is widely that the phenomenon of the transfer of the collective ownership construction land (shorting for : TCOCL)gets into market spontaneously by transferring,leasing,joint running,evaluating and becoming a shareholder . At the same time,collective land proprietary right is weakened , land assets are losing seriously , the efficiency of land allocation is lowered .Under the situation , the paper researches into some problems of TCOCL concerned .Firstly , introducing the phenomenon and the significence of TCOCL . According to the situation and the charactics of TCOCL , the auther analyzes its historical inevitability .Second , discusing the basis of TCOCL and putting forward the principle that it should be sticked to . Especially , for the key problem of TCOCL ---the allocation of the transformation income , the author raises the principle of three-side concerned .Third , introducing the mode of TCOCL . In the last part of the paper , from aspects of administration , law , technology , economic and guarantee , the author puts forward some policy and proposals on how to regulate TCOCL .
