Consideration To The Legislation Of Property Right System Of Forestry Resource

The legislation of property right is the focus of law today, and one important content in the future civil code. Forest resource is important natural resource and significant to the biosphere. The paper tries to build the property right system of forest resource from its dualism of economic value and zoological value. The paper claims that the using property right system of forest resource still has something to improve inspite of great breakthrough after two amendments. On the basic of property analyze, the paper presents the following projects: the movement of ownership between state and collectivity, also between collectivities; according to the traditional system to build usufruct system of the forest resource. Meantime, build the system of environmental rights and limit above-mentioned property rights so as to ensure the zoological function of the resource. The paper also analyzes briefly the possible matters in the legislation.
