As the opposite to free competition monopoly is an inevitable outcome, which is due to the development of socialization mass production. It can be found either in the market economy system or the planned economy system with the growing socialization of production.Since the socialist economy differs essentially from the capitalist economy hi ownership and production purpose, the cause and development of monopoly in these two societies are widely divergent. And this enables monopoly to play a different role in socialist economy and capitalist economy respectively.This thesis analyses today's monopoly in China and deals with its causes as well as features in the course of constructing socialist market economy, which are different from those in the western capitalist countries. Hence, it's necessary for China to draw a lesson from the West and formulate her own anti-monopoly law. This law must reflect the state's practical situation and claim the position of anti-administrative monopoly in anti-monopoly law.The essay gives an introduction to the theory of monopoly and presents that the discussion about monopoly in a certain country must be dealt with according to the country's existing economy, social system and culture. Next, it focuses on the types , causes and harmfulness of monopoly in China. Special attention is paid to the manifestation and process of administrative monopoly. In addition, the paper makes an account of anti-monopoly law, legislation method and its typical characteristics as well as the contemporary development tendency of anti-monopoly law in western countries. Finally, the author puts forward her own viewpoints about the regulatory object and range of anti-monopoly, the position of anti-administrative law in anti-monopoly, the application of anti-monopoly beyond its limits, the exemption systems, the legislative organs, the legal responsibility, for the aim of making the national anti-monopoly laws.
