Special and differential treatment (SDT) is a preferential treatment entrusted by WTO to the developing countries. It is also a manifestation of the developing countries' requirement for a fair and just international trade order. As a fair and mutual benefit principle which is in accordance with the international law, SDT was put forward on the history and status quo of developing countries under the multilateral trade system. SDT originated from GATT and its contents and system had been enriched and completed with multilateral treaties after the closure of Uruguay Round Negotiation and the establishment of WTO. Nevertheless, the enforcement of SDT articles is not so satisfying. SDT didn't improve the trade condition of developing countries and help them out of difficulties, moreover, it traps some least developed countries into the crisis of marginalization. This essay focuses on the enforceability of SDT articles through introducing the theories and practice of SDT's developing under GATT/WTO. It also analyzes the impediments that affect the practice of SDT articles in detail and put forward relevant suggestions on how to strengthen the enforceability of them. Finally, this essay points out the approaches that China-the biggest developing country should have.
