Research On The Assignment Of Credit

With the development of economy, the debt, as a kind of proprietary, has become the core of the property law .So it is of great significance to do basic research on the thesis. This dissertation, encompassed with the assignment of credit, intends to provide references to practice and legislation.There are five parts in this paper. The first chapter, beginning with the progress of history , concerns the definition, the legal features, and the economic value of the assignment of credit. . Then compared with other related systems, it points out the differences between them. The next three chapters are the core of this paper. Chapter II explicates the formal conditions of the assignment from the legal angle ,and makes an in -depth analysis on the sorts of the debt and the notice of the assignment. Chapter III makes a study on the content of the assignment contract, also it makes a research in a full scale on the legal relations between the assignor, the assignee and the debtor and on the internal and external legal validity of the assignment contract. Furthermore, Chapter IV ,aimed at the problems induced by the assignment , probes various parties' right conflicts and reassignment. Finally, based on the present domestic legislation related with the assignment of credit, offers some suggestions for the future legislation in this aspect.This dissertation combines the measures in analysis of comparison, illation and positivism, and makes a typical research on the assignment of credit. I hope the discussion, the conclusions and also the suggestions will be helpful to the practice and our state's legislation on debt assignment.
