The author considers the fundamental principles of WTO are the Freedom Principle and the Fairness Principle of International Trade. Although WTO haven't a written fundamental principle, we can arrive at these two points above by the following way: On one hand, we can exclude other principles as the fundamental principle according to my thorough and systematic theory of fundamental principle of law; On the other hand, we can prove that these two fundamental principles contain the fundamental values of WTO and they are the representations of the contradictory interest claims from the two interest groups of the international society trade order, which is built by WTO.The study on the WTO is a special topic of the International Economic Law, so a systematic, scientific, profound theory of the fundamental principle of WTO will provide a firm theoretic groundwork for the comprehensive and systematic study of WTO of the next phase. The profound understanding of the two fundamental principles and their essences will help us apprehend the rules and master the development of WTO. What's more, the understanding is the lodestar for we China to develop in the multilateral trading system by implementing our obligations and using our rights, and for the legislation in the new round of the multilateral trading negotiations.
