On Rights Of Public Opinion Supervision

The news public opinion supervision is an important component of our country supervisory system. Nowadays, the journalism develops so rapidly that the news public opinion supervision has been concerned highly by the Party and governments of all levels, and got wide attention and participation by the public .It has been playing a special and important role in the supervision of government, official, justice and celebrity. Then, how to make the news public opinion supervision work efficiently and not to infract other rights? The most important thing is to put it into the track of the law. This article begins with the public's basic rights and defines that the right of the news public opinion supervision is the prolongation of the public liberty of words, publication and suggestion defined by Constitution, and it is one of the basic rights. Meanwhile, through analyzing of the dualism of the news public opinion supervision and the specialty of the exertion, this article draws a conclusion that the right of the news public opinion supervision is a just right that between public right and private right. On the base of that, this article analyses the cases that the rights of the news public opinion supervision being infracted in practice, and puts forward the regulation to the right of the news public opinion supervision. Then, this article discusses how to regulate it. This article's purpose is not to limit the rights of the news public opinion supervision, but to decrease the number of lawsuits of news infraction, ensure the other's legal rights, and make it work better and better.This article analyses the exertion of the news public opinion supervision, especially the situation of the offside infraction, and does some research about how to regulate the right of the news public opinion supervision, from setting the bonder of the rights to defending the infraction, from the industry self-discipline of the media to the legal aid of the infractions caused by the news public opinion supervision, from learning the foreign country's experience to perfecting the lawmaking of our country ,exploring various paths and ways to regulate the news public opinion supervision. Some of these measures have been exerted, but still need to be strengthened, the others have to be embodied through the practice in future.
