On The Administrative Protection Of Intellectual Property

Protection of intellectual property rights is the key of intellectual property system.The administrative protection of intellectual property rights is undertaken by theintellectual property administrative authorities to provide the comprehensively legalprotection of intellectual property rights through the administrative regime. It includesgranting the intellectual property rights to applicants and hearing and deciding thedisputes about the right holder. In the forthcoming of knowledge-based economy, we need to reconsider therelationship among technology innovations, economy development, intellectual propertyand administrative protection. Meanwhile, systemic and effective reformation measuresshould be actively taken to make the administrative protection of intellectual propertysystem work properly and to meet the demands of new technology reformation andeconomy development. 3In China, the intellectual property administrative authorities have the power not onlyto grant the rights and hear and decide the disputes, but also to inspect the infringement ofintellectual property and punish the offenders. This is undertaken under the laws andregulations of intellectual property and administration. It has made remarkableachievements to intellectual property protection. However, some problems must beraveled out in this field. The consciousness of intellectual property protection should beheightened, the execution of administrative authorities should be under the laws and thejudicial protection of intellectual property should be strengthened. The paper firstly makes brief recommendation of the basic conceptions and theory ofintellectual property, and introduces the protection system of intellectual property,especially the characteristics of that in China. With that, it puts emphasis on theillumination of the meaning of administrative protection of intellectual property, and givesthorough analysis of the necessity of administrative protection through its theorybackground and system basis. In the end, the paper analyzes the existing problems, andthen puts forward relevant suggestions on the improvement of the administrativeprotection system of intellectual property in China.
