The Non-coercive Means Of Environmental Administration

Today, the task of the environmental administrative is seasoned with the demand of sustainable development to achieve the harmony between human and nature.With all the environmental law, there is the closest relationship between administrative law and environmental protection. It supervises all the behaviors of utilizing environment to avoid or alleviate the damages to the environment through environmental administration. Along with the reform and the development of public administration, the non-coercive means of administration, represented by guidance of environmental administration, has played and is playing important roles.This dissertation is aimed to analyze and describe some serious problems of theory and practice about the non-coercive means of environmental administration, and try to arrive at a correct understanding of the principle and efficient implementation of the non-coercive means of environmental administration. Several suggestions are further given of perfecting the system of the non-coercive means of environmental administration, in order to make it strong enough to bear, with other means of environmental administration, the historical responsibility of realizing the goal of environmental administration, and facilitating sustainable development and the harmony between human and nature.Section One of this dissertation is about the creation of the non-coercive means of environmental administration. This section begins with the important position of the non-coercive means of environmental administration and comes to the descriptions to the creation of the non-coercive means of environmental administration. And these descriptions are begun with several important factors about the creation of the non-coercive means of environmental administration.Section Two of this dissertation is about the characters and the adaptation to society. Firstly the characters of the non-coercive means of environmental administration are analyzed in this section, and on these bases the adaptation to society is demonstrated. To describe the adaptation to society, there are someimportant society value tropism factors described.Section Three of this dissertation mainly describes the value of the non-coercive means of environmental administration. This section bases on the section two and analyzes several important factors that related to the non-coercive means of environmental administration. To do this is to expatiate on the value of the non-coercive means of environmental administration.Section Four of this dissertation is about the operation and relief of the value of the non-coercive means of environmental administration. It concludes and analyzes the operation principles of the non-coercive means of environmental administration, and undertakes an institutional research of the non-coercive means of environmental administration in respect of the allocation of right and obligation, principle, procedure, relief and so on, in accordance with the principle of administration by law.
