Study On Products Liability In Macao China And Foreign Countries

Law n 12/88/M ( Protection of Consumers ) enacted in Macao recognizes local consumers' rights of claims and ensures them protection of health. However, consumers throughout the world haven't ceased to ask for more protection, due to the emergence of harmful products that resulted from the constant progress in world economy and technology. In order to enter the world market, Macao needs to enhance Protection of Consumers Law and to initiate the enactment of Products Liability.Since there's a lack of theoretical and technical studies in Macao, the present thesis aims at filling this gap by collecting data extensively, including visiting Macao Consumer Council. It involves analyses related to the development of Products Liability currently occurred in Macao, China and foreign countries, including analysis of legal precedent, concept of Products Liability, elements and effects of liability and resolutions to dispute, in order to improve the legal theory and system of Macao. The main objective is to present suggestions for the legal structure of future Products Liability in Macao, appealing for its early enactment to protect consumers' health.
