Make maritime investigation to the maritime accident is an important authority of maritime safety administration that authorize by maritime traffic safety iaw of People' s Republic of china. In the proceeding of maritime investigation, the maritime safety administration will make investigation to vessel, facility, and people which relative to the maritime accident firstly and then make use of the evidence which hold and looking for the reason of the accident, in the final determinant the liability of the relative party.It is the most important part to collect evidence, make use of evidence to recurrence the fact of accidence in the proceeding of maritime investigation.Make maritime investigation to the maritime accident is a concrete administry conduction in which the rights of relative part involved. These conductions should standard by administration law and evidence law. In Chinese, there are no rules about the maritime investigation now, which result to different ways in the evidence collection of maritime investigation. And these facts have negative infections to the authority of maritime safety administration.To the point of view of maritime safety administration execute the administrate power, this thesis make a brief introduce of the proceeding of maritime investigation and the law foundation of it, and discuss how to use the relative law to standard the action of evidence collection and the action of proof the accident fact. The thesis also makes research to the problem of the qualification and force of maritime investigation evidence that got by the new investigate way and the stander of the proof.The author tries to invoke the evidence rules of judiciary in the maritime investigation area, and being forward the accept stander to the maritime investigation.
