Undisclosed information is something into which intelligence of human beings has crystallized, and all nations have been aware of its economic value and potential competitive edge. More and more efforts are under way to strengthen the protection for undisclosed information due to its own value as undisclosed information and the flaws in traditional intellectual property rights protection legal system. Considering the fact that China has been a member of the WTO, it is necessary to integrate China's undisclosed information protection legal system into the WTO regime. This article, based on historically and realistically analyzing the undisclosed information protection system in the developed countries as well as prescriptions on trade secret in TRIOS, studying the history and disadvantages of China's undisclosed information protection legal system, offer some limited suggestions on the future legislation on China's undisclosed information as well as give some humble opinions on the recent judicial practice in the perspective of the degree of difficulty in undisclosed information cases.
