On The Development Of The Range Of National Compensation

This article is intended to have a probe into the development of the range of national compensation as a special subject .By briefing analyzing the factors that affect the ranges of national compensation and international compensation .it deals with the problems that are urgently needed settling in the range of national compensation to develop the range of national compensation in the direction of more advantageous right compensation.This article is divided into three chapters .The first chapter interprets the conceptions of the range of national compensation systems and affecting factors mainly focusing on the responsible principles of national compensation, national financial resources and the conventional ideas and ethics which affect the range of national compensation. The second chapter outlines the ranges of national and international compensations and makes an analysis in and comparison between them. Thus it induces the limits of the range of our national compensation: narrow compensational range; limited items for compensation; narrow range for compensation and its indefinite relevant conceptions. The third chapter is the body of this article, embodying the creativity and uniqueness. First it discusses about the importance of the development of the national compensational range. Then it defines the feasibilities for the development of the range of national compensation. At last it puts forward three problems which should be solved in the development of the range of national compensation; unclear responsible principles for criminal compensation;compensational problems caused by non-action impairment in administrative compensation; spiritual impairment pertaining or not to compensational range. The article is written in the order of Problems-Analysis of causes-status of lawful practice (case analysis) -Methods and suggestions for settling the problems. The writer hopes that through the probe, the article can offer some useful theoretical guide and suggestions in the amendment of the National Compensation Law to develop the range of national compensation.
