Analysis Of Chinese Re-built Imagination Of Criminal Investigation Patterns

Criminal investigation Patterns are the basic nucleus content at the stage of criminal investigation law suit. It embodies the relationships among all kinds of law suit main bodies and working styles of investigation powers; it reflects a country`s different views of aim of investigation, views of value of law suit and different law culture. Whether the investigation patterns laid out are scientific or reasonable or not directly influences investigation aims and the realization of many kinds of values of criminal law suit. At present some scholars in our country has done a lot of research and carried out necessary analyses. This paper through analysing the meaning of criminal investigation patterns and its law suit ideas, based on the comparison with different characteristics and common tendency of development between two genealogies of law, indicates the investigation characteristics and its disadvantages of power of office which attaches importance to punishing criminals, not protection; attaches importance to entity, not the procedures, Then this paper puts forward a re-built imagination to our country's investigation patterns from many aspects; such as ensurance of investigation methods, strict conditions of inestigation act, control of administration of justice to investigation rights, the relationship between police and procuratorial organs, the separation between detainment and taking into suspectors' rights and administration of justice relief. The aim of this paper is just to bring about more attention to criminal investigation patterns and push forward its reform and its legality of procedure just.
