Research On The Legislation Of The System Of Worker Participation

Since the twentieth century, the tendency of the development of company is towards scale, socialization and internationalization. The company has gradually become the basic economic cell in modern society. Where the democratic mode is included in this wide field of economy, it is social progress and a civilized sign to implement the system of worker participation in the company. A lot of countries have stipulated the system of worker participation in company laws hi different forms.The system of worker participation has already caused the concern of scholars in different legal fields, such as the company law, labor law, and the like. However, legislative research thereof is relatively a new subject at present. A lot of problems await being probed into and studied deeply.The worker participation in broad sense means that the worker participates in company's decision, administration, supervision and split of the profit to a certain extent through certain form. In narrow sense, it usually means that worker participate in company's administration. This dissertation probes into the theoretical foundation thereof, separately from economic democracy, community responsibility, behavior science and manpower capital as well. Without workers, the company cannot exist and develop. Many problems of the company in China are related to the ignoring of the function of workers. There are more realistic meanings in China to introduce the system of worker participation into corporate governance. Hence, we should study foreign relevant legal system and use for reference, and analyze the deficiencies existing in the current system of worker participation in our country, then probetentatively to the improvement of legislation on the Chinese worker participation. In China, the system of worker participation are mainly the system of congress of workers, worker supervisor and worker director. Research on the legislation about the system of worker participation mainly moves around the system of congress of workers, worker supervisor and worker director.
