Intellectual property protection mainly means the products and services of fmanci al innovation now. TRIPS mark anew level of the world's protecting of the intellectu al property rights. According to TRIPS, the products and services of financial innovati on, which are the intellectual achievements, should take the intellectual property. The se tell us that changes have taken place in the conception's intension and extension ofIntellectual Property. The objects of the intellectual property protection also become more and more extensive. It has been an international trend to protect theproducts andservices of financial innovation from the perspective of intellectual property.After China entering into the WTO, we must comply with the duties of the relev ant rules of GATS, quicken the step of reform and opening up, and allow the foreign f inancial institutions to enter into China's financial markets and have national treatme nts. We know that the foreign financial institutions have obvious advantages in the pr oducts and services of financial innovation. They will ask for the legal protection in t heir more advanced products and services of financial innovation. Thus the financial i nstitutions of China will take very passive position. Facing such a severe situation, thi s article puts forward the countermeasures that China should take from macroscopic s ide, one of which is that we should know the ways of intellectual property protection i n the west countries, the other is that we should analyze the practical problems and tr y to consummate the legal system of intellectual property protection of the financial i nnovation products and services.
