There are 210 million labourer namely worker taking salary income as main source of income in China. The definition of the trade union is in " trade union law " : The trade union is a mass organization of the working class which the worker combines voluntarily, All-China Federation of Trade Unions and every trade union represent the worker's interests, safeguard the worker's legitimate rights and interests in accordance with the law. But under the market economy, enterprises take place occasionally for the phenomenon of making the best economic benefits to encroach on worker's rights and interests , developing constantly in socialist market economy, under the situation that China has already joined WTO, how to safeguard the vital interests of this colonies of workers better, how to strengthen the maintenance function of the trade union in new period? This text has done some elementary discussions to these questions. On behalf of and safeguard the workers masses' legitimate rights and interesting, it is not merely determined by nature and aim of the trade union of our country, and the objective request of new situation and new characteristic that the present socialist market economy of our country faces. The issue and implementation of " trade union law " make the safeguarding the rights work of the system of the whole trade union make greater progress and develop. We should also realize clearly that the trade union safeguard the rights , it is an big complicated article , involve the change and adjustment of the power relations in many aspects and interests relation, so in the course of operating concretely, will have various kinds of difficulties with obstruction unavoidably. These difficult points have politics, there is economic field too; There is a external environment condition question, there is a reason of one's own quality too. Summarizing, there is the following several respect: First, the promotion of the economic system reform, is assaulting the traditional working way of trade union strongly , stress to the trade union that the function has formed the new challenge to safeguard the rights. In this periods, some trade union and to how worker is it maintain worker legitimate rights and interests define unclear to come in accordance with the law trade union, can't fulfil the function of safeguarding with perfect assurance . Second, the real state of the trade union makes it face the challenge in safeguarding the rights. Though the trade union has legal personality because of can bear the conditions , such as civil liability ,etc. independently, but in reality, leaders of the Party and the government of some enterprises, regard trade union as one's own department, it depends on the face of the administrative leader often that trade union president works. Third, the laws and regulations of the trade union have not still got the due attention and implementation so far. Though " trade union law " has been adopted and issued and implemented by National People's Congress for more than 8 years, but lead on the eyes in some, " trade union law " remain one department law, carry out " trade union law " thing of trade union, not big with the government, administrative relation, therefore it is not enough to pay attention to work of trade union, support and do one's best . Fourth, the quality questions of some cadres in the government and the Party make the maintenance work of the trade union difficult to launch, some legal ideas of leaders of the Party and the government are faint, ignore the status of a legal person of the trade union. Fifth, one's own quality of some cadres of the trade union is relatively low, practice has proved, as the worker of full-time trade union, especially not have higher politics , economy , law , culture , theory accomplishment to bear the president of trade union of leadership responsibility, do not have the love that the trade union works and master , has not dared to safeguard the daring and resolution of worker's rights and interests , it is impossible safeguards the rights...
