The Research On Contracted Management Right Of Rural Land

Contracted management right of rural land, as a creation of Chinese peasants, was put into practice over 20 years ago. Now it has become a legal system with the most Chinese characteristics. The system has been in practice for many years and made some success. But due to its own defects, some scholars bring up the idea that the concept of contracted management right of rural land can be replaced by such terms as permanent land-lease right, farming right and so on. The writer thinks that the concept should be continuously used and get perfect in academic theories and social practice. As the property law is being worked out, the writer tries to analyze the legal attribute and efficacy of the management right and its birth and elimination and other matters through the essential theories of property law. Finally, the writer draws a conclusion about the defects of the management right and put forward some suggestions of improvement, hoping it a little helpful to the legislation of China.
