More specifically, the dissertation launches its research from following three parts:Chapter 1 discusses the fundamentals of the victim's promise. On the essence of consent of victim, I insist the theory of measuring interest is rational and comprehensive . consent of victim have an different effect in criminal law ,and different effect produce the criminal impact.Chapter 2 discusses constitutive requirements of the victim's promise. Constitutive requirements consist of the subject having the ability of the promise, the victim getting the capacity of disposing in private behalf, promise being true and sincere, valid promise just occurring before promise or at present, promise showing the others definitely, the act being consistent with the content of promise.Chapter 3 discusses the victim's promise that is based on deducing. Discuss focus on constitutive requirements when the deducing promise is legitimate, on the specific form of for the deducing promise, and the legitimate ground being harmony of the society.
