Research On Crime Of Credit Cards Swindling

This article mainly researches on crime of credit cards swindling. It involves four chapters.Chapter one introduces credit cards and crime of credit cards swindling in brief, and mainly introduces legislations about crime of credit cards swindling at home and abroad. The author put forward his own definition to crime of credit cards swindling on basis of other existing definitions, and defines the range of credit cards.Chapter two is the core part of this article, it analyzes the constitutions of crime of credit cards swindling from criminal object, criminal objective elements, criminal subject and criminal subjective elements, of which the objective elements especially the four behaviors of crime of credit cards swindling are analyzed in detail.Chapter three analyzes the bounds between crime of credit cards swindling and other crimes, and the determinations of stealing credit cards and using them, falsifying credit cards and using them. The author mainly analyzes the determination and judicial application of stealing credit cards and using them, and put forward his own opinions.Chapter four mainly analyzes the accomplishment and attempt pattern and the complicity pattern of crime of credit cards swindling, here some knowledge of general provisions of criminal law is referred to.
