Legal Analysis On The Most-Favoured-Nation Treatment Of GATS

MFN treatment is one of the fundamental principles of GATS. It is very important to the GATS and the liberalization of international service trade that observing the clause in practice. Compared with the MFN treatment of GATT, it has its own characteristics on the terms and practice and so on , this is closely related to its background of forming and developing. In recent cases concerned about the MFN of GATS, we could find that the rules of applying and interpreting have been established gradually. And with the practice goes on , we also could find some new problems about the clause. For China's better understanding and using it in practice, it has important meaning to know the established rules and think about the existent and possible problems of the MFN treatment of GATS.
