Legal Control Of Soot Nuisance In Urban Catering Trade

This dissertation is focused on the soot nuisance in urban catering trade. Based on the analysis of the harm, characteristic, the present administrative system and the status quo of the legislation of the soot nuisance, the dissertation puts forward the following advice:First, we should establish the plural administrative mechanism including administrative department, enterprise and the public.Second, we should establish the reasonable plan and prevention first principle, the comprehensive administration principle, the polluter pay principle, good-neighbourliness principle and the public participation principle.Third, we should establish the urban ecological plan system, the assessment of the environment impact system, the three-simultaneity system, the charge for pollution system, the permission system, the public participation system and the environmental monitoring system.Fourth, we should strength the administrative legal responsibility and the civil legal responsibility of the soot nuisance.
