Comment On Offence Of Huge-sum Property From Unclear Source

Offence of huge-sum property from unclear source, appeared in the late 1980s, is an effective tool as net of justice for increasingly serious economic Crime in China. However, there still exists conflict in the criminal law study field since this offence is put into practice. From the viewpoint of legislative history and the value of offence of huge-sum property from unclear source, this article analyzes and explores the offence's possible problems in criminal constitution and justice application, as well as draws out personal understanding on Legislative improvement of offence of huge-sum property from unclear source. In the author's opinion, the found of this offence has its positive meaning. This article provides arguments and comments on the specific problem such as accusation, objective factors, possible inference, responsibility verification and the problems on justice practice. Finally, the author points out that to avoid the occurrence of corruption, it is necessary not only to improve the legislative system of this offence but also the supervision system of building employee's property claiming and financial supervision.
