Study The Establishment And Legal Effect Of The Shrink-wrap Contract

The Shrink-wrap Contract has been warmly controverted since it came into being, especially the establishment and legal effect of such contract Nowadays, different countries all over the world could not meet their consensus about this contract, and there is not any related regulation in our country.The dissertation is divided into three parts with more than 40,000 characters.In the first part, I am planning to put forward the question. Firstly I introduce some background knowledge of this passage, including the definition, origin, main types, object, nature of the Shrink-wrap Contract and so on, then I discuss the argument of the parties of such contract.In the second part, I am planning to analyze the question. While exploring the establishment and legal effect of the Shrink-wrap Contract, I mainly follow the principle ofstatus quo-legal prerequisite-conclusion, and utilize the traditional theory of civil lawto analyze such problem, and mainly elaborate the new characteristics of the Shrink-wrap Contract comparing with the traditional ones. When the Shrink-wrap Contract meets some conditions, I make a conclusion that the Shrink-wrap Contract is established and taken effect.In the third part, I am planning to settle the question. Through comparing 'Uniform Computer Informational Transaction Act' of the U.S. with the 'Contract Law' of china, I am going to talk something about the present conditions and improvement of the regulations on the Chinese Shrink-wrap Contract.
