A Systematic Analysis On The Interaction Between Technology And Law

The level of development of modern technology has already become a sign of national strength. The rise of technology law results from the development of both technology and law, and meanwhile it is an organic combination of the two. How to solve the new legal problems caused by the development of technology so as to enhance current jurisprudence and establish new laws? How to strengthen the legal system so as to guarantee and promote the development of technology? The abovementioned questions are of great practical value and they deserve an in-depth study and an appropriate solution.This dissertation firstly introduces the fundamental concepts of technology and law, traces their historical development and summarizes the interaction between technology and law, particularly technology law.Secondly, this dissertation analyzes and elaborates on the impact of technological development on laws, especially the impact of contemporary technological innovations on the establishment of patent law, trademark law, copyright law, environmental protection law and technological progress law.Thirdly, this dissertation analyzes and elaborates on the impact of law, especially technology laws, on the development of technology: the impact of the legislation of technology laws on the direction, rate and scale of scientific research, the promotion of the science popularization strategy as well as the guarantee of the transformation of technological achievement; the improvement in the global technological development as a result of the technological exchange and cooperation treaties.Finally, based on the analysis of the interaction between legislation and technology, this dissertation points out that compared with developed countries, legislation in China is still far from perfection, the legislation of technological innovation, high technology, and the conformation to the international conventions being the weakest. In addition, this dissertation presents a thorough analysis of the reason on the imperfection of the legislation. It argues that under the condition of new technological innovation, it is imperative to enhance the legislation of technology laws with the aim to provide a comprehensive and solid legal guarantee for a stable and enduring development of technology in China. It also puts forward several legal countermeasures to accelerate the development of technology in China.
