When it comes to pleading and defense procedure, it refers to a procedure according to which a plaintiff states his requests and conducts a defense with an indictment and defense paper. The specific items in a pleading and defense procedure vary from country to country owning to their different political, cultural, economical background and legal tradition. Comparatively, the United States and Britain take lead in the field. After repeated revision in the two countries, the procedure has been developed a great deal, thus allowing innovative lawyers to lodge complicated and new lawsuit, at the same time requiring lawyers, on the basis of previous stipulation, to institute new rights, which will satisfy the social demand. Not only does this promote the law development, but finds its more profound significance in the fact that disputes arising from wealth dispensation and human race could be solved by the way of individualized litigation. Thus, citizens are ensured the rights to seek legal protection and the opportunities to solve legal disputes when offended.Up to now in China no professional pleading and defense system has been established; "litigation and acceptance", though sharing affinities with its counterpart in other countries, is different in essence in terms of legislation purpose, system designing, etc. Civil Litigation pleading and defense system should be established and improved promptly to protect citizen's legal rights.
