Discussion On Perfecting The Public Participant Systems Of Chinese Environmental Law

To analyze theoretically from the specialization of environmental protection problem, this paper indicates that environment rights embody the ecological rights. The individual interest of citizen environment is the foundation of the public environmental interest. The public environmental interest is concentration of the individual interest of citizen environment. Only by perfecting citizen environment interest can we make the environment protection better. From the core conception of public participant-citizen environment right, the author dwelled on divergence of citizen environment right and tendency nowadays, which is the entity right and the procedure right .By doing this, the two rights will be reasonably posited and designed. The realization of entity right embodies citizen environment interest. The procedure right is a kind of necessary ways to realize the entity right. Only through the better operation and perfection of two aspects, can all-around protection of citizen environment right be realized in the end. The author analyzed the insufficiency of the public participant systems from the essence of environment right and proposed relevance suggestions, in order to solute the realistic law problem by little created cost. There are environment administrative in public system, environment legislation hearing of witnesses system, environment public interest litigation system, environment protection corporation system, environment propaganda and education system, etc. The public participant includes four aspects that are environment awareness, environment knowledge, environment morality and environment behavior. We have to enhance the social utilization of four layers so as to realize the conversion from public life style to environmental life style, and to make the public protect the environment willingly. In the future, the goal of environment rule of law and sustainable development of sociality will be realized.
