It is a long-standing problem that our country only recognized the bankruptcy of corporation but of natural person. The draft of new Bankruptcy Law had submitted to the Second Meeting of The Tenth National People's Congress. The suitable objects of this Law had contained not only the station-owned enterprises and partnership company, but also the commercial individual. It moved a step forward. But that is not enough only to confirm in Bankruptcy legislation. In order to give free rein to rule of the system for our country's reform, we should carry out a overall and systematic study and analysis to the commercial individual system. So it has significance to inspect and inquire the suitable object and feasibility of the commercial individual bankruptcy system.Compared to the bankruptcy of corporation system, the bankruptcy of commercial individual system had many difference in substantive law and procedural law. Some of these difference belong to technical nature and some belong to principle nature. My research topic intend to use the comparative method and the experience of other discipline for reference to study the bankruptcy of commercial individual . At the same time, the thesis develops concrete study by multiple and abstraction means. The main content of thesis including: target values of bankruptcy of commercial individual, feasibility study, suitable objects, some characteristic substantive rules and procedural rules, and sketch out several complementary reform systems, such as Social Security system, Credit system, Deposit by true name system etc.. The thesis hope to constructed a brief system of bankruptcy of commercial individual and hope to blaze new trails in theory of bankruptcy law.
