Study On Land Expropriation System Reform In Xinjiang

With the rapid development of China's economic construction and continuousadvance of urbanization process, land demand will present the extensive tendencyin considerable period of time in the future. Land expropriation is one of theimportant methods of ensuring the need for the land for our country's economicconstruction. However, in reality the development of our country's economy is oftenbased on the sacrifice of the agriculture and the farmers' interests. Because thedefect of current land expropriation system is increasingly obvious, landexpropriation system reform has become an important issue and caused the attentionof the experts not only in the land science field but also in the whole society,and its significance is far beyond land resource management itself. Hence it isnecessary to do some theoretical and empirical research into land expropriation andits influence. Since the new edition of《 Land Management Law 》was put into effect, manyparts of our country have met many new situations and new problems in land expropriation.Furthermore, more social problems are appearing. Xinjiang is no exception. Thispaper takes the land expropriation system reform in Xinjiang as its research objectand at the same time discusses the rights and interests' guarantee of farmers. Basedon qualitative and quantitative analysis of the current situation, characteristicsand problems of land expropriation in Xinjiang,the paper deeply studies the causes that have led to the problems from theoretical point of view, then using the experience of the common international practices and the domestic reform andexperiments, puts forwards its own opinions and solutions to Xinjiang's landexpropriation system reform. After a complete analysis, it will helpfully havea reference value on the land expropriation system reform and on the problems ofthe rights and interests' guarantee of farmers in Xinjiang.
