The criminal procedural law of China, revised in 1996, endows thevictims with the position of involved party in criminal lawsuit for thefirst time, which consummates the lawsuit rights of the victims to somedegree. However, no matter from the angle of our judicial practices, orfrom the angle of the related practices of safeguarding the victims'human rights in western countries, we still have a long way to go in thisaspect. Along with the unceasing development of theory of human rights, safeguarding the victims' human rights becomes the hot issue both in practice and in theory. How can we strengthen the safeguarding of the victims' rights under the condition of current system and approximately balance the national benefit, the defendants' human rights and the victims' human rights? Examining from the trend of international criminal legal system and even the social development, it is unavoidable to make the law of the compensation for the victims. And examining the current situation and borrowing the related experience from the countries with mature legal system, and then reconsidering the reasonability of the system of compensation for the victims in China and reviewing jurisprudent basis of this system, and then designing China's system of compensation for the victims are necessary to perfect the system of safeguarding the victims' human rights and improve the protection of human rights, and to realize the modernization of criminal procedural law and to change the essence of the criminal procedural law from single national standard to multivariate standard...
