21century is knowledge economy times.Science and technologyimpacts every aspect of the society.Judiciary appraisement(expert-witness)is applied more and more in the litigation.Its function has been enlarged greatly,and sometimes it is decisive.But we must。prevent it being used un—properly.At present,aiming to realize justiceand raise efficiency,we are making all evidence law.In our country,this is an exploit project has not been done before.So to compare and useothers'expefienc9 for reference is of consequence.Reform on Evidence institution is the pivot of our country'S judicial reform.And the Judiciary appraisement system is one important part of evidence institution.In our country,there are a lot of study on judiciary'appraisement,among which some study is on basic theory,some on reform of system,and some on legislation.But few review on checkupand admissibility of it. I deem evidence institution relates judicial trial pattern.Evidence law in Common law countries is advanced,and American expert-witness system is perfect and representative.Though my knowledge is scanty,I have collected,coordinated and applied a lot of foreign datum.Using case analysis method,I research on the admissibility of expert-witness in U.S.A.widely.This treatise compares these two systems of censoring on expert-witness admissibility,probes into difference and its cause of formation,analyzes problems in our present judiciary appraisement system.Through case analysis,I demonstrates the possibility of using admissibility system of American expert—witness for reference,and presents some suggestion on using it.
