Study On The Reasons Of Administration Violation During Resettlement And Countermeasures

It is a particular legal system of our country which deals with the problems that appeared during the resettlement of urban reconstruction. It involves kinds of respects, such as resettlement system, economy, culture, etc., which related to the important issues of the national economy and the people's livelihood. With the in-depth analysis of the politics system and economic system reform of our country, we can see that our country have already done a lot of corresponding adjustment and have made certain effects. Till now, the resettlement system of urban reconstruction of our country divides into 3 stages roughly from the last fifties: the resettlement system during the planned economic period; the system of the period of transition; the system under the market economic period. The resettlement improved the housing condition and the urban environment of citizens, stimulated the economic development. However, with the development of socialist market economy system, the present urban resettlement system is not yet perfect, it still exists a lot of problems. These problems involved each aspect of both sides of resettlement and also the arrangement of resettlement. In general, these questions include the evaluation during resettlement; large-scale resettlement; enforcement resettlement etc. On the basis of analyzing various kinds of problems appeared during the course of resettlement, the paper has analyzed the reasons causing these questions especially: such as the executers have mis-guiding problem, interests urging, getting unclear responsibility; the resettlors have the following problems such as concept, historical, realistic problem, etc. The resettlement system itself displays the uncompleted land use system, the contradiction among the systems of land ownership and right to use, the un-distinguished of the well-being purpose and commercial purpose, the resettlement administrative procedure violation, etc.. The paper proposed the measures and approaches to solve these problems; emphasized the standardization of the government's administrative behavior, complication of the relevant laws and regulations in order to maintain the stability of our society and the development of modernization.
