Real estate auction has turned to be a widely-used way of real estate transaction. It plays an important role in discovering price, speeding up liquidation and vitalizing real estate market. Real estate auction, compared with other auctions, is featured with high value, multi-party and succeeding property registration. Complicated legal relationship and disputes are always associated with it. Moreover, because of various understanding of related laws, people have lots of problems on settling disputes of real estate auction, especially on dealing with disputes resulting from real estate defects. Legal research insufficiency has made it hard to resolve these disputes. As a result, cases are suspended or sentenced with widely divergent results. In this article, the author intends to discuss disputes which are resulted from real estate defects based on the point of interest balancing. It focuses on the theory of exemption clause, relationship of property registration and property transfer, as well as property acquisition in good faith, so that an interest equilibrium of all the parties is built up and serves disputes settlement in real estate auction.
