The Contract Management Under The Platform Of The Valuation With Bill Of Quantity

"Code of valuation with bill quantity of construction works" will be carried out of our country in July 1, 2003. The valuation with bill of quantities is a very important step to the reformation and the perfection of managerial system. It is a new valuation mode compared with the traditional valuation ways depending on the ration. That is to say, the construction price depends on the market in which the buyer and the seller of the construction products can bid freely according to the information of supplying and demanding, and sign the contract price eventually.But nowadays during the period of transformation from the planned mode of "combination of quantity and price" to the marketable mode of "separation of quantity and price", we are short of suitable contract for construction and effective methods for contract management which is seasoned with the new valuation mode. So this task must be studied on as urgent as we can in the aspects of the theory and the reality.Making use of material of "Code of valuation with bill quantity of construction works", contract clause at home and abroad and some legislative authority relative to contract management, this paper is taken a systematic discussion on the problem on contract clause, contract management and claim under the new valuation mode. On one side, it is tried to establish a new conditions of contract, which can reflect the characteristics of the valuation with bill quantity. At the same time, it also suits to the demand of the contract management. On the other side, on the basis of studying on the specialty of the new valuation mode, this paper is focused on the constitution of contract management to fit for the project management and the architectural market. Of course, claim on project should not be neglected either.First of all, on the basis of research on the building market and contract management of our country in the current situation, the full text sets up a set of contract management system for the new valuation mode. In studying the foundation of the knowledge systems of the contract and contract management, compared with FIDIC contract terms, it explains the question of setting up contract managementsuited to the news valuation modes from these angles, such as conclusion, performance, claim of the contract under the mode. The questions happened in the process of the contract management under the platform of valuation with bill of quantity is been discussed, and some practical suggestions are provided. Comparing with the valuation clause of FIDIC contract and NEC contract, it is studied on establishing our country's contract terms under the new valuation mode. It is studied and described foreign construction project claim management methods, procedure and principle, analyzed FIDIC claim clause, expounded the claim management under the valuation with bill of quantity and the some correlative impact on the expenses claim.
