On The Crime Of Trade Secrets Infringement

Though the Crime of Trade Secrets Infringement is governed by the Criminal Law of our country nowadays, it is still a new kind of crime to us. It is very useful to discuss and study this kind of crime. The author will research the theory and practice about the Crime of Trade Secrets Infringement based of the grounds of its coming into being.This thesis includes four chapters. In chapter one, the author states the valuation of Trade Secrets and the grounds of such crime. Chapter two is an introduction on the legislation of our country about such crime. In this chapter, the author states the definition of such crime, the characters of such crime and the content of the Criminal Law of our country on the Crime of Trade Secrets Infringement. Chapter three is a part in which the author analyzes the characters of such crime governed by abroad laws. The author compares the legislation mode, the designation, the structure, the punishment and the mode of accusation governed by the law under the Continental Legal System with ones governed by the law under the Britain-American Legal System. In the last part of this thesis, the fourth chapter, the author gives relative suggestions on the legislation include the legislation mode, the designation, the structure, the punishment and the mode of accusation. Such problems are surely needed to be resolved as soon as possible.
