The Research About Corruption Crime

The crime of embezzlement is a kind of high-frequency, seriously harmful duty-related economic crime, and is one of the major reflections of the corruption of public servants, do the law of our country strictly punish it. The new criminal law absorbed the successful experience of former legislations, and become more scientific and rational. However, it's inevitable of the existence of the controversies over many problems about the crime of embezzlement, because the regulation in criminal law is absurd and the factual life is complex, this article probed into the subject, objective elements etc,of the crime of embezzlement from six aspects. The article is based on the regulation in force now, and the author discussed the scope and the defection of the subject, the abject and the target, the two objective requisites, the holding on nature of the complicity of mixed subjects, the holding on attempt, circumstances and measurement of penalty through comparison, analysis and synthesis. The article researched the scope of the subject, the violated social relations, held on nature of mixed property, explained the meaning of "taking advantage of duty" and how to hold the ways of "possessing the public property illegally", probed into the holding on the nature of complicity of mixed subjects and the holding of attempt, and made the relation between the circa stances and the measurement of penalty clear.
