With a systematic integration of the theory of traffic delinquency crime, the thesis gives a tentative analysis of the following questions: the subject and the object of the traffic delinquency crime, the objective aspect and the subjective aspect of the traffic delinquency crime, the escape and the death caused by escape and the instigation to escape. And some superficial suggestions are put forward in the thesis. The whole thesis is composed of seven chapters: Chapter One: Introduction. This chapter describes the objective, the approaches and the significance of the current study. Chapter Two: Basic characteristics of traffic delinquency. With a study of the theories proposed by many scholars in this field, we put forward our point of view on the requisites to constitute a traffic delinquency. Chapter Three: Various escapes in traffic delinquency. Since the regulations in the law and the related judicial explication concerning the escape in traffic delinquency are obscure and confusing, many controversies exist in the theoretical study. Our basic standpoint on this issue is illustrated in this chapter. Chapter Four: Comparisons of the legislation of traffic delinquency in china and abroad. With a discussion of the legislation of traffic delinquency abroad, we holds that it is necessary to study their legislation carefully so as to draw inspiration from them and improve our legislation. Chapter Five: The principle of trust and traffic delinquency crime. This chapter expounds the principle of trust, and transforms the traditional theory of criminal negligence so as to achieve the legislative aim of restrict the charge of traffic delinquency crime. Chapter Six: Strategies for traffic delinquency crime. This chapter illustrates the reasons for traffic delinquency and also suggests some measures and strategies of containment. Chapter Seven: Conclusion. This chapter is a summary of the whole thesis, and it also suggests the urgent necessity of amending the law concerning traffic delinquency crime.
