Some Basic Issues Of The Power Of Public Prosecute

The power of public prosecute is the basic power of the system and procedure of public prosecution, run through all the related theory and practice .To study the power of prosecute can not only help us to assure the character of public prosecute totality, but also help us to rethink the public prosecute system and improve it . but in China ,we haven't study the power of public prosecute systematically. To fill the vacant position of our study, this article chooses some basic theory problems and begin with the evolution of the power of prosecute, gain the concept of it and study the character of the power of public prosecute—the character of administration, the character of commonweal and the character of procedure . After this part , the function of the power of public prosecute —the function of balance and the function of decompose have been studied, the basic principles of the power of public prosecute have been summarized. At the end of the article ,the writer analyzed the important part of the power of public prosecute—the discretion of public prosecute, such as the basic theory of it,the extent and the restrict of it and at last bring forward some suggestions under the situation of our country .
