Political Modernization And The Construction Of The Rule Of Law

This academic paper is made up of two different parts. In the first part, I analyzed therelationship between the political modernization and the construction of the "rule of law ". Inthe second part, I argued how to construct political modernization and the rule of law, and putforward key problems which must be settled in course of it.In the first part, beginning with the definition of political modernization. I held thatpolitical modernization is important target on the way to the modernization of china. For the"rule of law "is the basic way to political modernization, it is naturally an outstanding andfundamental security of the political modernization. Meanwhile, I pointed out clearly that"politics governed by law"is necessary to "political modernization.In the second part, I brought out the concrete measures to construct the "politicalmodernization "and "the rule of law"from three aspects, such as how to building legalculture, controlling political power by law, building socialist democracy and so on.Concerning the building of legal culture, I stated the legal culture is a premise to the"political governed by law"and that strengthening the "rule of law "must rely on the supportof culture from the aspects of economics and culture. Both leader and the common peopleto establish the belief that law is the adore everything else, the most trust worthy and the mostrevered by people.With regards to controlling of political power by law, beginning with the definition ofpolitical right and the necessary of restriction right. I advised control power can from fiveaspects, which are legal restriction,system restriction, restriction of party discipline andgovernment discipline, restriction of party and people. I claimed that it is the most importantto control power by law includes distributing power by law, supervising the performing ofpolitical power by law, correcting power abusing.As for strengthening the construction of socialist democracy, I stated the relationshipamong democracy, political authority and "the rule of law". I continued to state the necessaryof the construction of democracy from that to realize the changes of administrative form,economic operating form, social administrative form and interest structure all need strengthensocialist democracy. In order to strengthen the construction of socialist democracy, we shouldimprove the system of People's Congress, electoral system and democratic legislation system.At last, I concluded that we must construct the political modernization andthe "rule of law"simultaneously.
