There was a kind of particular judicial culture existed in the legal culture of the ancient China, in which some honest and upright officials who have many specific good features were called "Qing Tian", the spirit and the story of them were wildly praised and spread till now and been the model of today's officials and the spiritual handholds of populace. Under this king of background, the judicial tradition of ancient China is remaining unremittingly. Maybe it complied with the people psychology and the social value orientation in that specific age, but, at the same time, incurred many negative effects to the after development of the legal.This paper started from the research of Chinese legal culture, pick the caste of the judicial honest and upright officials in ancient China as the key point, analysis the existed legal culture phenomenon in that age through the angle of the tendency of worship for "Qing Tian", the honest and upright officials, from the populace. And the reasons and results incurred by the tendency were mutually supportive imperceptibly, which consolidated such culture phenomenon on and on.The paper consisted by 6 parts:Part I is foreword, mainly introduce the meaning of the topic selected, research purpose and the current status of the research.Part II is the chapter one, epitomized the mainly common features from 5 aspects which are dedication and honest, distinguished politics achievement, integrity, good observation and judgment and value the human relationship and the ethics, and trying to conclude the commonness of such kind of historical figures from the historical record. Part III is the chapter two, deep analysis the kind of worship consciousness, or the root of the honest and upright official culture through the two parts of the disyllabic phrases "Qing Tian", the word "Qing" and the word "Tian". The word "Qing" metaphor the other Chinese word "Qing", the latter embody the honest and upright official culture which is proper in China, and the word "Tian" analysis the reason of the "Qing Tian" worship from the aspects of traditional theory on human nature and the government official consciousness.Part IV is the chapter three, this chapter mainly focus on survey the bad effects in legal area that were resulted by the "Qing Tian" worship tendency: abuse the human relationship and the judicial officials becoming the key factor in cases lead to a lack of the legal authority, populace expect the "Qing Tian"s, who were seemed like some omnipotent person, to dispose everything cause it was hard to separate the judicature and administration, persist in the thinking of defending the weak and avenge the wrong leads to a kind of legal notion which is pay attention to the entity and ignore the procedures, and over rely on the "Qing Tian" and depress the individual development cause the poor individual and democracy awareness.The part V, the chapter four, briefly complements how the certain legal culture impact the rule of law construction in current society. Although the blind worship for the "Qing Tian" must be rejected stoutly, but we can not totally negated the personal quality of those ancient honest and upright judicial officials and they have many good character which worth everyone to learn. Meanwhile, we also can dissect the problem from another perspective that is to turn the blind worship into supervise and accountability.At last is the epilogue, the part VI, social civilization is continuously, we have to analysis and appraise the legal culture in ancient China objectively and rationally, and only in this way we can help and push the law construction in modern society have a good developing.
