The Study Of The National Defense Patent Legal System

Intellectual property strategy has become an important component of development strategy as China's entry into WTO. Intellectual property system is very important in national defense field because high-tech in national defense plays an important role in modernization construction of national defense and national economy.In this study, the development of national defense patent system was summarized by researching the legal system of national defense patent in developed country. Experience and defect of current patent system in China was analyzed and improvement of national defense patent system was also investigated.This study provided the concept, emergement and development of national defense patent and then analyzed the difference between national defense patent and common patent. It was elucidated that important position and role of national defense patent in weaponry and equipment construction.Three different modes of privacy patent system were analyzed in this research via classification of secret patent system model in foreign countries in order to understand the reference value to Chinese national defense patent.Considering the challenges of national defense patent system after China's entry into WTO, the suggestion to national defense patent was displayed in this study.
