The Abuses And Reforms Of Chinese Border Law Enforcement System

China's current border law enforcement system was originated from the time not long after the foundation of the People's Republic of China. It was designed according to the phasic task at that time and used Soviet Union's mode for reference. The three major functions of this system are entry and exit border inspection, administration of frontier, law enforcement at sea. It played a significant part in preventing enemy spy's activities in China's border in the early stage. However, as the reform and open policy goes further and the development of the society and economy, the current system has already failed to meet the need of our country's development. The problems and demerits of this system are becoming more and more obvious. For example, there are two systems of entry and exit border inspection in China. One is of military service, the other is of local sector. They are respectively affiliated to two different departments in The Ministry of Public Security. The setting up is not reasonable and makes the coordination poorer. Border police stations belong to the system of military service, but what they are responsible for,mainly maintaining and administrating the security of their areas, is the same as the local ones. Generally speaking,their professional skills are not very qualified. Apart from the coast guard, there are still four major administration departments participating in the law enforcement at sea. Therefore, the situation caused by multi-thread law enforcement, overlap of authority and the swelling of organization is awkward.In order to adapt to the change of time and the development of economy, China's border law enforcement system ought to follow the trend of our country's reform in terms of administrative law enforcement and actively do some bold experiments. For instance, State Council once organised researches on law enforcement at sea, with an attempt to set up a comprehensive law enforcement system at sea. Since the interests among departments are hard to coordinate, this attempt resulted in nothing. The professional reform on entry and exit border inspection system in nine cities improves both the competence of law enforcement and the quality of service. However, there are still many problems and disadvantages, which urgently need further reform. Only by doing so, can we better safeguard the sovereignty and interest of our country, and improve the ability of law enforcement and quality of service.Based on comparing the systems of border law enforcement in major nations around the world, this thesis analyzes the state of China's border law enforcement system, including existing problems and causes, and probes into the reform on the theoretical basis of China's border law enforcement system, by applying related knowledge of Science of Public Administration, Administrative Law and Administration Science.
