The principle of non-extradition of the death penalty is the modern extradition system's product.though it formed later, it has a rapid development in recent years.At present,It becomes an important principle of extradition cooperation and arouses widely public concerns. With the decelopment of the protection of human rights, the principle of non-extradition of the death penalty has become a close combination of protection of human rights and extradition coorperation. As a result,the principle of non-extradition of the death penalty is consided as a reason or the restrictive condition of refusing extradition cooperation.In recent years,china has been making afforts to extridite the criminals who flee outside,to some degree,we obtain some achievement on this issue.however china still encounter many difficults because of the differences of social institution and judical system between china and the relative Countrys,especially, at present china still not abolishing the death penalty.I hope I can provide some suggestions on utilizing this principe through the in-depth description of the thoery of the principle of non-extradition of the death penalty.
