Research On Activism Mechanism Of Legal Aid

China's legal aid system, as an important part of the harmonious society, is getting more and more attention. Mainly based on the value orientation of China's legal aid, this paper studies the theoretical basis, practice needs and components of the active mechanism of legal aid. This essay mainly studies the activeness of the legal aid and discusses how to explore the activeness. Establishing legal aid system is the important legal guarantee of legal equality, and activism mechanism of legal aid is the guarantee of implementing citizens'equal rights. Therefore, a activism mechanism of legal aid is essentially the scientific implementation system of perfecting the legal aid, aims at explore the iniative of legal aid, finally, to maximize the realization citizens'equal rights on the basis of legislation for legal aid.This text discusses theoretical basis of activism mechanism of legal aid, analyses the characteristic, legal basis and essence. The first two problems preliminary analyse the possibility of implementing the activism mechanism of legal aid in China recently while the essence is to analyse the necessity of implementation. The possibility and necessity of activism mechanism of legal aid is the basic premise of the whole research.Then this essay refers to the current practices of legal aid in our country. As any institutions need to be examined in practice, this part analyses the implementation of legal aid in our country and problems, such as, passive manners of working, fund shortage, unobvious social effects. Towards these problems, according to the first part, this section explores the causes, so as to lay the foundation for further study.The emphasis and main content of this paper is based on the studies in the former two parts, attempts to discuss how to construct the activism mechanism of China's legal aid, in essence, is to construct implementation system of perfecting the legal aid, aims at how to give full play to the subjective activism role of existing legal-aid work, and integrate all resources of legal aid, in order to maximize the social effects. The essay proposes the reasonable constructions in aid agencies, social resources involvement and so on, to form a set of perfect scientific implementation mechanism. So as to realize the grand goal-"harmonious society" eventually.
