As the main way to access the population, torture exists legally for a long time at home and abroad in judicial history. However, with the development and progress of human civilization, more and more people perceived that torture as a grave violation to human rights and human dignity, and contrary to human civilization and progress, not only was a serious violation to the legitimate rights and interests, but also seriously undermine the judicial image, damaged law enforcement credibility. Today, torture has been banned around the world and such activity is published. Many scholars and legal practitioners on the phenomenon of torture have conducted in-depth research in stopping torture in many beneficial aspects of exploration, made a lot of good practice and good results. However, the emergence of torture still happens from time to time in the public sight. As a grass-roots level for many years in the judicial police, I would like to have in-depth study to work experience in judicial practice,, try to figure out the acts of torture, and its development and change process, in order to find its law and in accordance with the law of torture to find countermeasures to curb torture.This paper is divided into five parts.The first part defines the behavior of the torture. Based on the explain of the torture act, this paper introduces the historical development and characteristics of torture.The second part analysis the causes of the torture. This parts gives the causes of torture, such as ideas causes, low economic and technological, imperfect of the system, lack of detection capability and the interrogation techniques of interrogators.The third part demonstrates the harm of torture to the rule of law in our society. It not only prevents the improvement of interrogation techniques scientific, but also hinders the cultivation of legal belief, and results in the resistance to the legal system.The forth part gives a strategy to prevent torture by the innovation of thoughts and systems. By establish of concept of respecting for and protection of human rights in modern legal, we should improve systems and mechanisms to prevent torture, such as establish and promote the whole system of audio and video recording, improve rules and regulations to strengthen construction sector, establishment of community organizations to strengthen inspection to places of detention, pay more attention to decision-makers, efforts to improve the detection capability, Strengthen media and press supervision, and so on.The fifth part gives another strategy to prevent torture by the improvement of interrogation techniques, such as "Nine-step interrogation methods", association response method of interrogation and so on. This paper also gives methods of interrogation for our state, and strives to improve interrogation techniques by the improvement of the quality of judicial officers.
